    Terms of Service

    These Terms of Service ("Terms") govern your use of Click Desk POS and all other products and services provided by Click AI Agency ("Click AI Agency", "we", "us"). By creating an account or using our services, you agree to these Terms.

    1. The Service

    Click Desk POS is a software-as-a-service restaurant management platform. It provides features including but not limited to bookings, floor plan management, order processing, kitchen displays, receipt printing, cash management, staff PINs, and reporting.

    2. Account eligibility

    You must be at least 18 years old and legally able to enter into a contract in your country. You represent that the business information you provide is accurate.

    3. Your account

    You are responsible for keeping your account credentials secure. Notify us immediately at security@clickaiagency.com if you suspect unauthorised access. You are responsible for all activity that happens under your account.

    4. Acceptable use

    You will not:

    • Use the Service for anything illegal
    • Attempt to reverse-engineer, decompile, or bypass security measures
    • Resell or sublicense the Service without our written consent
    • Use the Service to spam, harass, or defraud
    • Upload malicious code or attempt to overload our infrastructure

    We may suspend or terminate accounts that violate these rules.

    5. Fees and payment

    Fees are as displayed on getclickdesk.com/pricing or as separately agreed. Fees are billed monthly or annually in advance. All payments are non-refundable except where required by law. Prices exclude VAT unless stated.

    6. Your content and data

    You retain ownership of all business data, customer data, and menu content you upload to the Service. You grant us a limited licence to process that data solely to provide the Service. See our Privacy Policy for details on how we handle personal data.

    7. Availability and support

    We aim for 99.9% uptime but do not guarantee uninterrupted service. Planned maintenance is announced in advance where possible. Support is provided via email and live chat during UK business hours.

    8. Third-party services

    Some features rely on third-party providers (Stripe for payments, Twilio for SMS, ElevenLabs for voice, etc.). Their terms may apply in addition to ours.

    9. Termination

    You may cancel your subscription at any time from within the app. On cancellation, your data is exported on request and deleted within 90 days per our Privacy Policy. We may terminate your access if you materially breach these Terms.

    10. Warranty and liability

    The Service is provided "as is" without warranty of any kind. To the fullest extent permitted by law, our aggregate liability to you under these Terms is limited to the fees you paid in the 12 months preceding the claim.

    Nothing in these Terms excludes liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under UK law.

    11. Changes

    We may update these Terms from time to time. Material changes will be notified by email at least 30 days in advance. Continued use after changes take effect means you accept them.

    12. Governing law

    These Terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.
